1. Acceptance of this Agreement
This End User License Agreement ("Agreement") is between you and BullTech, a French SARL (Société à Responsabilité Limitée) with SIREN registration 530991975 and registered office at Paris 75011, France ("we", "us", "our"), the developer of MakeNess AI (the "App"). By downloading, installing, or using the App, you agree to this Agreement. If you do not agree, do not use the App.
This Agreement supplements, and does not replace, Apple's Standard End User License Agreement and the App Store's Terms of Service, which also apply to your use of the App.
2. The Service
MakeNess AI lets you chat with, and generate text, images, and video through, a range of third-party artificial intelligence models, plus tools such as AI agents, an AI keyboard, and widgets. The App requires no account, no email address, and no sign-in — it is designed to work anonymously, as described in our Privacy Policy.
A free tier is available to everyone. Paid Plans and optional Sparks credits unlock additional or faster access, as described below.
3. Subscriptions and Payments
The App offers optional auto-renewing subscriptions ("Plans") at weekly, monthly, or yearly intervals. Two tiers are available:
- Basic Plan — adds a wider range of powerful chat models, standard AI image creation, and smart model routing.
- Premium Plan — includes the world's most powerful AI models, advanced image generation, custom AI agents, web search, app creator, learning mode, priority support, and more.
Video generation is not included in any Plan. Video is paid per creation using Sparks by every user, at every tier, including Premium — see Section 4 and our Sparks page.
Current pricing, included usage, and renewal terms are always shown in the App before you purchase, and may vary by region and promotion. A free tier with essential everyday chat is available to everyone, with no purchase required.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period, in your Apple ID account settings.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- Refunds are governed entirely by Apple's App Store refund policy. We cannot issue refunds directly — refund requests must go through Apple at reportaproblem.apple.com or your Apple ID purchase history.
- Your subscription status (active, expired, tier) is verified on our servers using Apple's StoreKit APIs, to keep access accurate and prevent fraud.
4. Sparks (Virtual Credits)
"Sparks" are optional, pay-as-you-go virtual credits you can buy separately from, or alongside, a Plan. Full plain-language details, current per-creation prices, and how Sparks interact with Plans are kept up to date on our Sparks page, which forms part of this Agreement by reference. The core rules are:
- Sparks are sold in fixed packs through Apple's In-App Purchase system, at the price shown in the App at the time of purchase.
- Sparks do not expire.
- Sparks have no cash value, cannot be exchanged for cash, are not transferable between accounts or devices, and earn no interest.
- Sparks are spent at the per-creation price shown in the App at the time of use. Prices differ by creation type (text, image, video) and by model, and may be updated from time to time; the price shown at the moment you generate is the price charged.
- Sparks are spent in exactly three cases: (a) you have no active Plan; (b) you choose an AI model above your Plan's tier, at the price shown on that model; or (c) your Plan's usage allowance is exhausted for the current period and you have enabled the "Use Sparks when my plan limit is reached" setting, which is off by default. Where your Plan covers a creation, its allowance is always used first and no Sparks are spent.
- Video generation is never covered by any Plan and is always paid with Sparks, at every tier including Premium.
- Once a Spark is spent on a completed creation, it is not refundable, except where a creation failed to generate through no fault of yours, in which case it is automatically returned to your balance.
- Purchases of Sparks packs themselves are subject to Apple's standard App Store refund policy (see Section 3).
- Sparks are linked to your anonymous account identifier for this installation of the App. If you delete the App, or move to a new device without using "Restore Purchases", unused Sparks may become inaccessible. We recommend restoring purchases before switching devices or reinstalling.
5. Acceptable Use
You agree not to use the App to generate, request, or distribute content that is illegal, infringes on third-party rights, or violates Apple's App Store Review Guidelines, including content that is unlawful, harassing, defamatory, or sexually exploitative of minors. We may suspend or terminate access for accounts that violate this section.
6. Your Content and Generated Content
You retain ownership of the prompts and files you submit ("Your Content"). Subject to applicable law and the terms of the underlying AI providers (Section 7), you own the output the App generates for you and may use it for any lawful purpose.
Generated content (images, video, and similar media) is temporarily stored on our servers, typically for up to 24 hours, solely to deliver it to your device reliably (for example, after a temporary network interruption). It is not kept for training or shared with third parties beyond what Section 7 describes.
We make no warranty that AI-generated content is accurate, complete, or suitable for any particular purpose. You are responsible for reviewing generated content before relying on or publishing it.
7. Third-Party AI Providers
To generate a response, the specific prompt and any attached files you submit are sent directly to the third-party AI provider(s) that power that request. Examples include providers of models such as GPT (OpenAI), Claude (Anthropic), Gemini (Google), Grok (xAI), Midjourney, Runway, and others. Each request is sent only to the provider needed to fulfill it.
We are a small, independent developer that contracts with these major AI providers using their standard API terms of service. We do not sell Your Content, and we do not have special negotiating power to modify these providers' standard training policies. Your prompts and files are subject to each provider's own terms of service when they process them. Some providers may use aggregated, non-identifying data for service improvements; refer to each provider's privacy policy for details. We recommend reviewing the relevant provider's privacy terms if you are concerned about how your data is handled by them.
We are not responsible for the availability, accuracy, output, or data practices of third-party AI providers, which may change their models, terms, pricing, or availability at any time.
8. Intellectual Property
The App itself — its design, code, trademarks, and branding — is owned by us and protected by intellectual property laws. This Agreement grants you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial or lawful commercial use, in accordance with this Agreement.
9. Disclaimers and Limitation of Liability
The App is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by applicable law. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App. Nothing in this Agreement limits liability that cannot be limited under applicable law, including French consumer protection law where it applies to you.
10. Termination
You may stop using the App and delete it at any time. We may suspend or terminate your access if you violate this Agreement. Sections that by their nature should survive termination (including Sections 8 and 9) will continue to apply.
11. Changes to the App or this Agreement
We may update the App and this Agreement from time to time. We will update the "Last updated" date above when we do. Continuing to use the App after a change takes effect means you accept the updated Agreement. Where a change is material, we will make reasonable efforts to bring it to your attention in the App.
12. Governing Law and Jurisdiction
This Agreement is governed by the laws of France, without regard to its conflict-of-law principles. Subject to any mandatory consumer-protection rules that entitle you to bring a claim in your own country of residence, the courts of Paris, France have exclusive jurisdiction over any dispute arising from or relating to this Agreement or the App.
